2. In general

These Purchase Terms (Pre-Contractual Notices) form part of the Seller’s obligations in accordance with the provisions of the Consumer Protection Act and are intended to ensure that the Buyer, before entering into a distance contract, is informed in a clear and comprehensible manner about all circumstances essential for the conclusion, execution and termination of the contract.

The term “Seller” refers to the trading company Mom’s Pants d.o.o., Zagreb, Medvedgradska 43, OIB: 73688520835, MBS: 081483624.

The term “Customer” refers to:

  • a consumer (natural person) who, outside any business activity, orders and pays for products via the web store on the Seller’s website
  • artisan buyers, individual traders and natural persons who perform business activities, who are protected by the provisions of the Consumer Protection Act only if they purchase products not related to their business activities
  • all other customers, including legal entities.

By selling through the website www.momspants.com, the Seller acts in its own name.

These Terms of Purchase form part of the distance contract together with the specifications and prices of the purchased products. Before confirming an order for the purchase of a product, the Customer will be asked to confirm that they are familiar with and agree to these Terms. After the order is confirmed (the contract is concluded), the Terms are delivered to the Customer as part of the e-mail message confirming that the contract has been concluded.

The Seller reserves the right to change these Terms at any time. Changes come into force upon publication on the website.

When the Customer confirms and completes the order, the contract is considered concluded. The Seller will immediately inform the Customer of the conclusion of the contract by e-mail. For a valid contract, the Customer must be a person with full legal capacity. The Customer is responsible for the completeness and accuracy of the data entered during registration.

These Terms describe the entire process of ordering, payment, delivery, exchange and return of products, as well as handling of complaints and termination of the contract.

Access to the website www.momspants.com may sometimes be unavailable due to maintenance, upgrades or unforeseen circumstances beyond the Seller’s control. The Seller will attempt to remedy such situations as soon as possible.

In justified circumstances, where misuse of the website is determined, the Seller may disable access to the site/web store. The Seller also reserves the right, at its own discretion, to refuse access to any visitor/user at any time. Any inappropriate use of the website/web store will result in the inability to use it.

The supplier (Seller) of items offered on these pages is Moms pants d.o.o., and the Customer is a visitor to the Moms pants web store who has selected at least one item via www.momspants.com, filled in an electronic order form and sent it to the Seller.

Products can be ordered every day, 0–24 h, through the web store. Order receipt confirmation is sent to each Customer’s e-mail address.

3. Protection of intellectual property

The Mom`s pants website and web store contain materials protected by copyright and intellectual property rights, including but not limited to texts, applications, photos, videos, graphics, music and sound, unless otherwise stated.

It is not permitted to change, publish, transmit, reproduce, participate in the transfer or sale, create derivative works or otherwise exploit any content, in whole or in part, without the express written consent of Mom`s pants d.o.o.

Visitors to the site or web store are not authorized to download, reproduce, modify, edit, distribute, display, delete, send, sell, resell, adapt or otherwise modify copyrighted materials in any way except for their own personal use.

For the avoidance of doubt, Mom`s pants d.o.o. expressly reserves, and does not transfer to the user, any rights in relation to the content of the web store and website, and prohibits the use of such content except as determined by these Terms and as may be explicitly permitted on the web store itself.

Individual photos and other materials may be published exclusively for advertising purposes, with a clear indication of the source and link, in a way that clearly shows to third parties that the content was taken from www.momspants.com.

4. Contract conclusion procedure

The conclusion of a contract through the Mom`s pants web store represents the conclusion of a distance contract.

The contract is concluded as follows:

  • The Customer selects the desired item from the range of items available on the website, in the desired color and size, and adds it to the shopping cart.
  • After adding the item to the cart, the Customer follows the web store instructions and chooses the payment method and delivery method.
  • After selecting the payment and delivery method, the Customer confirms the order by clicking the “confirm order” button.

The contract is considered concluded once the Customer receives an order receipt confirmation at the e-mail address provided when placing the order.

5. Main features of the product

All products displayed on the web store are shown in images with the available size and possible choice of color/pattern or material, if available for that product.

Product photos on the web store are illustrative and may not always fully match the product delivered.

Differences between the displayed and delivered product may occur due to:

  • the type and settings of the Customer’s monitor or screen,
  • individual perception of colors,
  • other technical circumstances beyond the Seller’s control.

Product information (descriptions, prices, etc.) on the web store is subject to errors and technical irregularities. In the event of obvious errors or malfunctions regarding product information on www.momspants.com, the Seller reserves the right to unilaterally terminate the contract.

6. Product prices

In accordance with applicable regulations, prices in the Mom`s pants web store are expressed in euros and, alternatively, kuna, and include VAT. The price stated for each item applies to one product unit.

The Seller may reduce or increase product prices at any time without prior notice. Products ordered will be delivered at the price valid at the time of submitting the order.

The prices are valid until a new price list is published. The Customer pays the price valid at the time of ordering.

7. Methods of payment

Several payment methods are available:

1. CorvusPay by IBAN – transactional payment

Payment directly via IBAN. This method can be used by Users who have internet or mobile banking with one of the banks connected to CorvusPay. The transaction cost is the same as with standard internet or mobile banking.

2. Payment by internet banking or general payment slip

The User receives a pro forma invoice with payment details and deadline to the provided e-mail address. If the User does not pay within the stated deadline (24 hours), the order is considered cancelled.

3. Payment by bank card (one-time)

Payment via web browser using supported bank cards. Mom`s pants accepts:

  • Maestro Card
  • MasterCard
  • Visa Card
  • MaestroPlus Card
  • Diners Card

4. Payment on delivery (cash on delivery)

The Customer pays the ordered goods in cash directly to the delivery person upon collection.

8. Online payment security statement

When paying in our web store, CorvusPay – an advanced system for secure online card payments – is used. CorvusPay ensures full confidentiality of your card data from the moment you enter it into the CorvusPay payment form.

Payment data is transmitted in encrypted form from your web browser to the bank that issued your card. The web store does not have access to your full card details.

The data is not accessible even to CorvusPay employees. An isolated core independently handles sensitive data and keeps it fully protected.

The payment form is secured with SSL encryption of the highest reliability. All stored data are additionally encrypted using a cryptographic device certified according to FIPS 140-2 Level 3. CorvusPay meets all security requirements prescribed by leading card brands and operates in accordance with PCI DSS Level 1, the highest standard of the payment card industry.

For cards included in the 3-D Secure program, in addition to card validity, your bank also confirms your identity using a token or password.

Corvus Info treats all collected data as banking secrets. The data are used exclusively for the purpose for which they are intended.

By maintaining strict access controls, security monitoring, vulnerability checks and information security procedures, the level of protection is continuously maintained and improved.

9. Product delivery

Shipping costs are not included in product prices.

Products are shipped throughout the Republic of Croatia via the GLS delivery service. Delivery is charged for all orders and amounts to EUR 4.13 / HRK 31.08 plus VAT.

Delivery will be made as soon as possible. Under regular circumstances, delivery time is up to 5 working days (including the day the package is picked up by the carrier).

On the Croatian mainland, packages are delivered on the next working day after pickup, and no later than within 5 days, during working hours (8:00–17:00). Transit times to islands can be checked with GLS Customer Service or on their website. The second delivery attempt is free.

International delivery: 1–7 working days, depending on destination (indicative transit times shown on GLS website).

In case of unilateral termination of the contract, the cost of returning goods is borne by the Customer.

If you notice external damage to the packaging upon delivery (e.g. wet, torn or open box), please do not accept such shipment and inform us immediately at [email protected] so we can take the necessary steps.

If, after accepting a shipment with undamaged outer packaging, you find that the contents do not match your order, please contact the Seller as soon as possible at [email protected].

10. Return of goods / Right to unilateral termination of the contract

Every Customer has the right, without giving reasons, to unilaterally terminate a contract concluded through the Mom`s pants web store within 14 days.

The 14-day period starts from the day:

  • the goods are handed over to the Customer or a third person designated by the Customer who is not the carrier;
  • for multiple items delivered separately, from the day the last piece is handed over.

To exercise the right of unilateral termination, the Customer must notify the Seller before the deadline expires, using the form for unilateral termination of the contract or any other clear statement expressing the wish to terminate the contract.

The form or statement is sent:

  • by e-mail to: [email protected], or
  • by registered mail to the Seller’s registered office.

The Seller will promptly confirm receipt of the termination form/statement.

11. Refund to the customer after returning the goods

In case of termination of the contract, both parties must return what they received under the contract:

  • the Seller returns the money received,
  • the Customer returns the goods.

In case of unilateral termination, the Seller will refund the Customer within 14 days from the date of receipt of the termination notice.

If the Customer has already received the goods, the Seller will refund the money only after the goods are returned or after the Customer provides proof that the goods have been sent back.

After receiving the goods, the Seller is authorized to inspect them and, depending on their condition, decide on the refund amount.

Once the goods are handed over to the Customer or a person designated by the Customer (other than the carrier), the risk of accidental loss passes to the Customer, who must handle the goods with due care until the expiry of the termination period.

The Customer is responsible for any reduced value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods (e.g. repair costs, new packaging, cleaning).

If it is visible that the goods have not been handled with due care (damaged, worn, without packaging or labels), the Seller may reduce the refund amount proportionally to the loss of value.

Refunds are made using the same payment method used by the Customer, unless the Customer expressly agrees otherwise and does not bear any additional costs.

If the Customer paid via company transfer, the Seller will refund the amount to the account specified by the Customer.

12. Return of goods by the customer in case of termination

To obtain a refund, the Customer must return the goods without undue delay, and no later than 14 days from the day on which they informed the Seller of the unilateral termination.

The goods must be returned:

  • unworn,
  • undamaged,
  • in original packaging,
  • with all labels attached.

After determining that the goods meet these conditions, the Seller will issue a refund.

The cost of returning the goods in case of unilateral termination of the contract is borne by the Customer.

Mom`s pants d.o.o. reserves the right to recover costs incurred in handling unjustified returns, where the delivered goods correspond to the order and have no defects.

The Customer cannot unilaterally terminate contracts relating to:

  • goods made according to the Customer’s specifications or clearly tailored to the Customer (e.g. custom-made by measurements),
  • sealed goods not suitable for return for health or hygiene reasons if unsealed after delivery (e.g. underwear, swimwear).

13. Replacement of purchased goods

If the Customer has purchased an item but the size is not suitable, it may be exchanged for another size.

To request an exchange, the Customer must contact Customer Support via [email protected]. After checking availability, Customer Support will inform the Customer whether exchange is possible.

Exchange is possible only if the item:

  • has not been used/worn,
  • is undamaged,
  • is in original packaging, including labels.

If the desired size is not available or the Customer wants to exchange the product for a different product, the rules on unilateral termination of the contract apply instead of exchange.

14. Complaints / Material defects of goods

The provisions of the Consumer Protection Act and the Obligations Act apply to material defects.

Material defects may include, for example:

  • tears in clothing,
  • stains,
  • missing parts,
  • fabric damage, etc.

The Seller is responsible for material defects existing at the time the risk passes to the Customer (as a rule, at handover), as well as for defects arising later if they result from a cause that existed before the risk passed.

The Customer’s rights in case of material defects include:

  • repair,
  • replacement,
  • price reduction,
  • termination of the contract.

To exercise rights based on material defects, the Customer must:

  • notify the Seller of visible defects within two months of discovering them, and no later than two years from the transfer of risk;
  • notify the Seller of hidden defects within two months of discovering them, and no later than two years from transfer of risk.

The Seller is not responsible for defects that appear more than two years after handover.

If, at the time of concluding the contract, the Customer was informed of certain defects and explicitly accepted the goods in such a condition, they lose the rights they would otherwise have had based on the rules on material defects.

The Seller will acknowledge receipt of the complaint and, within 15 days of receiving it, clearly inform the Customer whether the complaint is accepted and state the reasons for the decision.

15. Alternative Resolution of Consumer Disputes (ARPS)

Any dissatisfied Customer can resolve disputes out of court via the European Commission’s online platform:

Through this platform, consumers can resolve disputes with traders with the assistance of an impartial alternative dispute resolution body.

After the Customer and the trader agree on which body will resolve the dispute, the platform forwards the case to that body. The chosen body must resolve the dispute within 90 days.
